ALCANCE DE LA LIBERTAD RELIGIOSA EN PARAGUAY FRENTE A LOS DERECHOS FUNDAMENTALES DE LA SALUD Y EDUCACIÓN

Abstract

This article refers to the scope of religious freedom in Paraguay compared to the fundamental rights of health and education because in recent years various actions have been raised before the judiciary in order to make religious freedom prevail in matters of health and education. The objective of this investigation was to analyze to what extent this freedom prevails over other rights and what the Court establishes in this regard. The methodology used is explanatory, addressing the opinions of members of the Supreme Court of Justice in different rulings, as well as what was resolved at the international level by the Inter-American Court. For this, we worked with the bibliographic review, the study of cases, doctrinal and jurisprudential contributions at a national and international level. The analysis showed that religious freedom has a broad scope as it is considered a fundamental right, which must be respected at all times and is only limited in situations that the law expressly provides to safeguard essential rights of greater relevance.
