jurídicas relativas al derecho a la educación, igualmente, se adopta un método
comparativo de análisis de normas entre Paraguay y España, siguiendo una sistemática
comprensiva secuencial. Se propone, así, exponer qué normativas están vigentes y cuáles
necesitan ser reformadas, actualizadas o, incluso, derogadas, a fin de garantizar realmente
el derecho a la educación de niñas, niños y adolescentes. La investigación adopta un
enfoque socio jurídico puesto que busca reflexionar, desde lo jurídico sobre problemáticas
sociales. Como resultado preliminar de la investigación se confirma que la violencia
familiar es un elemento de vulneración al derecho a la educación de niños, niñas y
adolescentes en Paraguay. Se concluye que los niños, niñas y adolescentes que resulten
tanto víctimas directas como indirectas de violencia familiar o violencia de género tienen
mayor probabilidad de abandonar sus estudios.

Abstract
From the universal recognition of the right to education as a human right to the present
day, notable social and legal changes have been experienced on a global scale. However,
currently, the real and effective access to education, especially for children and
adolescents, continues to be an unresolved issue in many societies. In this context, from
the field of legal sciences, it is appropriate to provide effective answers to the phenomena
that create or accentuate the violation of the right to education in childhood and
adolescence, preventing its exercise and realization. One of the violations that affects the
full exercise of the right to education of children and adolescents is violence, particularly
school violence, gender violence, and domestic violence. This paper is part of a doctoral
thesis research whose object of study is the analysis of the main violations of the right to
education of children and adolescents in Paraguay. As part of the research work, it has
been detected that one of the violations affecting children and adolescents regarding their
access to and permanence in the educational system is domestic violence. The general
objective of this doctoral research has been to analyze what normative adjustments should
be made to prevent the increase in the violation of the right to education of children and
adolescents, which, in turn, can lead us to identify the damages or prejudices generated
and the corresponding responsibilities. Regarding the research methodology, it is
